Ex-Kumho chief arrested over embezzlement charge, may be liable for Asiana woes (박삼구 前 금호아시아나그룹 회장 계열사 부당지원 혐의 구속)

박삼구 전 금호아시아나그룹 회장이 총수 지분이 높은 계열사를 부당지원한 혐의(특정경제가중처벌법상 횡령 등)로 13일 구속됐다. 일찌감치 회사 경영에서 손을 뗐지만, 회사가 매각되는 상황까지 초래한 것에 대한 책임에서 자유로울 수 없다는 지적이다.

Park Sam-koo, former chairman of Kumho Asiana Group was arrested on Thursday on embezzlement charges and may come under liability for causing liquidity squeeze in the group and Asiana Airline that cost the airliner to go under Korean Air Lines.

박 전 회장은 총수일가 지분율이 높은 금호고속의 자본 사정이 나빠지자 아시아나항공, 금호산업 등 계열사 9개로 하여금 금호고속을 지원하도록 지시한 혐의를 받는다. 금호고속은 약 1300억원 가량을 무담부 저금리로 융통해 약 169억원의 금리 차익을 얻었고, 박 전 회장과 총수 일가는 특수관계인 지분을 통한 이익과 결산 배당금 약 79억원을 챙긴 것으로 조사됐다.

Park is accused of ordering nine of Kumho Asiana Group's units including Asiana Airlines to funnel about 130 billion won ($115 million) in low-interest unsecured debts to aid Kumho Busline, through which the former chairman and his family controlled the transportation conglomerate. Kumho Busline reportedly profited about 16.9 billion won while Park family pocketed some 7.9 billion won in dividends and other profits.

지난해 8월 공정거래위원회는 이같은 혐의를 포착해 시정명령과 과징금 320억원을 부과하고, 박 전 회장과 법인 등을 공정거래법 위반 혐의로 검찰에 고발했다.

The Korean fair trade agency slapped the group with a 32 billion won penalty after completing investigation in August last year and pressed charges against the former chairman and the group for violating fair trade law.

그룹 전략경영실이 아시아나항공 기내식 독점사업권을 넘기는 거래에 금호고속 투자 조건을 달아 여러 업체에 제안한 것으로도 조사됐다. 박 전 회장 측은 그룹이 적정 금리로 자금을 대여한 것이란 취지로 주장하고 있다. 검찰은 또 앞서 금호아시아나 그룹 윤 모 상무가 공정위 직원에게 417만원을 주고 공정위가 확보한 자료중 '박삼구' 등이 나온 부분을 삭제한 것을 파악하고, 지난 1월 윤 상무와 공정위 직원을 구속 기소하기도 했다.

The group is also found to have organized unfair inter-affiliate business transactions to monopolize gains from in-flight meal service operation. In January, a former group executive and a former fair trade agency officer were arrested for allegedly conspiring to delete documents unfavorable to the company.

이스타항공 전 회장인 이상직 무소속 의원 역시 횡령•배임 혐의로 지난달 28일 구속됐다.

His arrest follows another pretrial detention of bankrupt budget carrier Eastar Jet's former owner.

이스타항공 창업주인 이 의원은 이스타항공 주식을 자녀들이 주주로 있는 이스타홀딩스에 저가 매도해 이스타항공에 430억여원 상당의 재산상 손해를 끼친 혐의를 받고 있다.

Lee Sang-jik, founder of Eastar Jet and an independent lawmaker, on April 28 was arrested on charges of embezzlement and breach of trust. Lee is alleged to have caused about 43 billion won in financial damage to the budget carrier by underselling company shares to the holding entity where his children own a large stake.

이스타항공은 2019년 경영난에 시달리며 제주항공과 매각 협상을 벌였지만, 제주항공이 불확실성이 크다는 이유로 인수 계약을 해지한 바 있다. 이후 인수자를 찾지 못한 이스타항공은 올해 1월 법원에 기업회생절차를 신청했다.

Eastar Jet is currently under bankruptcy protection. It had sought new ownership under the country's leading budget carrier Jeju Air amid severe liquidity troubles, but the deal collapsed last year due to growing risks from Covid-19 pandemic.
